1. General Provisions
1.1. These Terms of Use govern the use of the free online service KoDrop ("Service"), designed for direct, temporary file transfer between devices.
1.2. The service provider and administrator is the Service Operator ("Operator"). All inquiries, notices, and communications with the Operator are conducted exclusively via the contact form on the website.
1.3. Using the Service (specifically uploading or collecting a file) constitutes full and unconditional acceptance of these Terms.
2. Service Characteristics & File Lifecycle
2.1. KoDrop allows transferring a single file of supported formats (PDF, JPEG, PNG, WebP) up to 20 MB per transfer.
2.2. Uploaded files are stored encrypted on the server and remain available for collection for a limited validity period (normally up to 15 minutes after upload completion).
2.3. Upon expiration or successful download, the file is automatically, permanently, and irreversibly deleted from the server. The Service does not maintain backups and cannot restore deleted files.
3. User Obligations & Responsibilities
3.1. Users agree to use the Service strictly in compliance with applicable law, good faith, and these Terms.
3.2. Rights to Content: You represent and warrant that you hold all necessary copyrights, licenses, and permissions for any files you upload. You bear sole civil, criminal, and administrative liability for uploaded materials.
3.3. Prohibited Content: It is strictly forbidden to transmit unlawful content, malware (viruses, ransomware, trojans, exploits), defamatory or hateful materials, or files infringing on third-party intellectual property or privacy rights.
3.4. Collection Code Confidentiality: The one-time collection code and QR code serve as authorization keys. You are solely responsible for securely transmitting the code to your intended recipient. Anyone with the valid code can claim the file before it expires.
3.5. Duty to Keep Originals: You must always keep your own original copy of transferred files.
4. Complete Disclaimer of Warranties & Limitation of Liability
4.1. "AS IS" and "AS AVAILABLE": KoDrop is provided strictly on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to fitness for a particular purpose, merchantability, uninterrupted operation, or error-free transmission.
4.2. No Liability for Data Loss: The Operator shall in no event be liable for any loss, corruption, damage, delay in delivery, or failure to collect transferred files.
4.3. Technical Disruptions: The Operator is not liable for interruptions, server overloads, network outages, DDoS attacks, maintenance downtime, or force majeure events.
4.4. Third-Party Actions: The Operator is not liable for unauthorized code interception resulting from insecure user devices or networks, or for file claims made by unauthorized parties holding a valid code.
4.5. No Liability for Content: The Operator does not author, inspect, or endorse user-transmitted content and accepts no liability for damages resulting from user files.
4.6. Exclusion of Consequential Damages: To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from the use of or inability to use the Service.
5. Violations and Suspension
5.1. Violations or technical issues must be reported exclusively via the contact form on the Service.
5.2. The Operator reserves the right to immediately block transfers, IP addresses, or access upon reasonable suspicion of terms violation or service abuse.
6. Final Provisions
6.1. The Operator reserves the right to modify these Terms or suspend, modify, or terminate the Service at any time without prior notice.
6.2. These Terms shall be governed by and construed in accordance with the laws of Poland.
6.3. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the competent courts of the Operator's registered seat.
